San francisco: Apple has filed a lawsuit against OpenAI, alleging that the AI company obtained confidential information through former Apple employees, potentially affecting OpenAI's device development if the claims are validated. The lawsuit, filed in the US District Court for the Northern District of California, seeks injunctions to restrict the use of alleged trade secrets, alongside damages and the return of Apple material.
According to Anadolu Agency, the defendants in the case include OpenAI Foundation, OpenAI Group PBC, hardware subsidiary io Products, and former Apple employees Chang Liu and Tang Yew Tan. Apple has brought forward trade-secret misappropriation claims under the federal Defend Trade Secrets Act, as well as breach-of-contract claims against Liu and Tan. The case is in its early stages, with no court ruling yet on whether OpenAI or the individual defendants misused Apple's information.
Apple's lawsuit follows an internal investigation that uncovered efforts to obtain information about unreleased products and other proprietary information. The complaint highlights Liu's alleged access to internal systems, downloading of sensitive presentations, and advising a colleague on how to bypass Apple's security systems. Tan, who co-founded io Products and serves as OpenAI's chief hardware officer, allegedly used supplier information and internal project names during interviews with Apple employees.
The lawsuit claims that OpenAI and io Products contacted Apple suppliers using confidential knowledge, leading to unauthorized processes being carried out. Additionally, OpenAI is accused of circulating an Apple document on security procedures and advising recruits on avoiding scrutiny when leaving the company. Apple asserts that over 400 former employees now work at OpenAI, and while it does not dispute the legality of hiring them, it alleges OpenAI sought protected information.
Apple contacted OpenAI in February regarding these concerns but claims it received no meaningful response. OpenAI's spokesman, Drew Pusateri, stated that the company is reviewing the complaint and emphasized that OpenAI is focused on innovative technology development, with no interest in other companies' trade secrets.
In terms of legal strategy, Apple must demonstrate that the information in question qualifies as a trade secret, prove reasonable steps were taken to protect it, and show that it was acquired or used improperly. OpenAI may argue that its technology is independently developed or based on publicly available information. Apple seeks injunctions to prevent the defendants from using its confidential information and aims to recover its materials and losses.
The potential consequences of the lawsuit could include delayed hardware development for OpenAI, increased costs, and complications with suppliers. The discovery process might reveal internal communications and documents, further impacting OpenAI. The case could also pose reputational risks and affect OpenAI's future public trading plans, as investors may demand details about the lawsuit's implications.
