Trump Administration Faces Legal Challenge Over Canadian Tariffs

Washington:Gellert Global Group, a US food importer, has initiated legal proceedings against the Trump administration, contesting the 50% tariffs imposed on certain Canadian goods. The company claims that these tariffs exceed the scope of presidential authority.

According to Anadolu Agency – English, the lawsuit was filed by the Liberty Justice Center on behalf of Gellert Global Group and a proposed class of affected importers in the US Court of International Trade. The legal action seeks to have the tariffs declared unlawful, their collection stopped, and refunds issued with interest.

The tariffs in question were introduced under Section 338 of the Tariff Act of 1930, a measure intended to counteract foreign discrimination against US commerce. However, the lawsuit contends that this provision has been superseded by Section 301 of the Trade Act of 1974, which requires investigations, public input, and other measures for addressing unfair foreign trade practices.

The lawsuit further alleges that the administration did not adhere to a required 30-day waiting period before expanding the tariffs. Canadian cheeses imported by Gellert were added to the tariff list on September 8, with duties starting to be collected on September 15.

Additionally, the Liberty Justice Center has filed requests for a preliminary injunction to prevent further tariff collection and a summary judgment in favor of Gellert. The legal challenge questions the administration's rationale, citing Canadian retaliatory measures and dairy policies under the US-Mexico-Canada Agreement. It asserts that some products, such as Canadian cheeses, are unfairly targeted due to disputes over alcohol policies and automobile duties.

Gellert Global Group, a family-operated food business, specializes in importing and distributing products within the US and supports American producers in accessing international markets.
